VW Transmission Class Action Lawsuit Settlement Reached


Volkswagen Jetta and Tiguan vehicles allegedly have defective 8-speed transmissions.

November 26, 2021 – A settlement of the VW gearbox class action lawsuit was reached after customers complained that the 8-speed gearboxes had several defects.

Volkswagen denies all allegations, claiming that the transmissions on the 2019 VW Jetta and 2018-2020 VW Tiguan are working properly and are not defective. But the judge allowed plaintiffs to amend their class action lawsuit four times, which Volkswagen eventually sent to the settlement table.

The VW gearbox class action lawsuit was filed by three customers.

California plaintiff Dominique Parrish owns a 2019 Volkswagen Jetta and says the transmission rattles and was not repaired by a dealer.

California plaintiff Ludwig Combrinck rented a new 2018 Volkswagen Tiguan and complained about a transmission oil leak that was being repaired under warranty and the hard shift from first to second gear that he claims was not repaired.

Plaintiff Trine Utne of Utah rented a new 2019 Volkswagen Tiguan and complained about problems with the transmission that were not repaired.

Plaintiffs allege Volkswagen “calibrated the transmission software to shift into higher gears at insufficient speeds and insufficient revolutions per minute (‘RPM’) and also programmed the torque converter to lock at insufficient speeds and insufficient speeds.”

The gearbox class action lawsuit alleges that the 8-speed gearbox “rubs, chafs, scrapes, grinds, suffers hard and sudden shifts, slow acceleration, hesitation, shifting gears, and ultimately broken seals and oil leaks, all of which are catastrophic Failure leads ”.

The 8-speed gearboxes supposedly contain separate issues, with certain 2019 Volkswagen Jetta vehicles having rattling noises from the gearboxes.

Then other 2019 Jettas suffer from transmission oil leaks from the radiator seals, and 2018-2020 Volkswagen Tiguans reportedly experience transmission delays or juddering.

VW transmission class action settlement

All current and former owners and renters of Jettas 2019 can receive software updates of the transmission control modules and damper weights installed on the drive shafts.

The Jetta must be diagnosed with rattling due to the transmission and the update will be available for up to a year from the date of the class action lawsuit.

In addition, current or former owners or lessees of Volkswagen Jettas 2019 can be reimbursed for the cost of repairing a diagnosed gear rattle. Repairs must be paid for in advance of the cancellation date and within 72,000 miles of the vehicle’s date of service.

If the past transmission repair was done by a non-Volkswagen dealer because of noise, the Jetta owner must provide documents to prove that the owner first tried to have the repair done by a dealer under warranty, the VW -However, the dealer has declined or was unable to repair for free under warranty.

VW Jetta customers of the 2019 model year can also receive an extended warranty based on the chassis numbers. The extension covers repairs to transmission oil leaks caused by the O-rings for a period of 12 months or 12,000 miles from the original transmission warranty.

The extended warranty requires that either (i) Service Action 38C5 (entitled ‘Transmission Oil Cooler Seals’ issued by VWGoA on the 25th member submitting a statement (which does not otherwise contradict VWGoA’s records) confirming that it is not was previously notified of the availability of service action 38C5 and that the service action was carried out on this vehicle within thirty (30) days after the cancellation date. “- VW transmission billing

VW Jetta customers may also be eligible for other refunds, but there are currently several terms in order to receive payments.

For Volkswagen Tiguan 2018-2020 customers, the warranty is extended to 12 months or 12,000 miles for repairs related to transmission delay and jerking.

Emissions recall 24 GB (Eligible Engine and Transmission Control Module (ECM / TCM, issued by VW on September 16, 2020) must have been performed prior to the extended warranty repair.

Tiguan customers may also be eligible for certain refunds for paid repairs related to jerky and hesitant transmissions. However, terms and conditions apply and customers are required to provide documentation.

Nothing about the VW transmission class action settlement is official until the judge gives preliminary and then final approval of the settlement agreement.

The class action lawsuit against VW transmissions was filed in the US District Court for the Central District of California: Parrish et al., V. Volkswagen Group of America, Inc.
