Toyota, Consumers End Class Lawsuit Over RAV4 Gas Tank Capacity

Toyota Motor Sales USA Inc. and 39 SUV owners have agreed to drop a proposed multistate class action alleging the RAV4 hybrid’s gas tank capacity requires drivers to refuel more frequently than they expected, according to a filing in federal court in California.

Whether the voluntary dismissal reflects a settlement of the consumers’ individual claims wasn’t clear from the document. Neither Toyota nor attorneys for the vehicle owners immediately responded to a request for information.

The parties will bear their own costs and attorneys’ fees, they told the US District Court for the Northern District of California Monday.
