In the case, it is alleged that PureCycle and its officers have made misleading statements to investors and have failed to disclose that: (i) the Procter & Gamble licensed PureCycle technology has not been proven and poses serious problems even on a laboratory scale; (ii) the challenges arising from the availability and competition for the raw materials necessary to commercialize the licensed technology are significant; and (iii) PureCycle’s financial guidance is unfounded.
Interested PureCycle investors have until July 12, 2021 to seek advice and apply as the lead plaintiff if they are interested. A lead plaintiff is acting on behalf of all other members of the investor class in administering the class action. Investors do not have to be a lead plaintiff to be a class member. If investors fail to take action, they can remain an absent class member. The class has not yet been certified. Investors will not be represented by a lawyer until certification.
