Nationwide Class Action Lawsuit Filed Against Symmetry Energy for Excessive Natural Gas Pricing During Texas Winter Storm
HOUSTON, April 16, 2021 / PRNewswire / – An award-winning, historic Texas Company filed a proposed statewide class action lawsuit against HoustonSymmetry Energy Solutions, based in Symmetry Energy Solutions, which claims customers illegally cut prices on natural gas during the nationwide winter storm in February.
The lawsuit filed by Certified Roses Inc., a TylerThe garden rose maker and wholesaler based in Symmetry says it has exceeded Symmetry’s bill for this month $ 248,000with a line item greater than $ 233,000 for “additional delivery costs” between February 10th and 22nd.
Certified Roses, founded in 1949, has been renewing an index-based price agreement with Symmetry every year since 2015. The lawsuit alleges that the contracts do not mention or define the possibility of such line item costs and do not explain the extent of the risks involved from a pricing calculation based on Inside FERC’s gas market report.
According to the filing with the federal court, Symmetry “did not have sufficient natural gas. To meet the needs of its customers, Symmetry secured gas, but faced cuts.” The lawsuit alleges that Symmetry circumvented its contractual obligations and exploited its customers at a vulnerable time by attempting to pass on excessive costs and fees to its customers.
The filing alleging breach of contract, misrepresentation, negligence, and violation of the Texas Deceptive Trade Practices Act requires a statewide class certification. Symmetry is believed to have more than 100,000 residential and commercial customers in 30 states.

Law firm Potts is also leading the class action lawsuit against Griddy Energy for similar price cuts during the Uri winter storm. Griddy Energy recently filed for bankruptcy.
The lawsuit is Certified Roses Inc. against Symmetry Energy Solutions LLC, No. 2: 21-cv-00133, filed in United States District Court for the Eastern District of Texas, Marshall Division.
