CASE DETAILS: According to the complaint filed: (1) the partnership had issues with the Lampung charter of PT Perusahaan Gas Negara’s (“PGN”) floating storage regasification unit (“FSRU”); (2) as a result, the charterer would declare to PGN FSRU Lampung that it would initiate arbitration to invalidate the charter and / or terminate the charter and / or seek damages; (3) the partnership would need to find alternative refinancing for their PGN FSRU Lampung credit facility; (4) the PGN FSRU Lampung credit facility matured in September 2021, not October 2021 as noted above; (5) the partnership would be forced to accept less favorable refinancing terms on the PGN FSRU Lampung credit facility; (6) Hoegh LNG would not extend the partnership’s revolving credit line beyond the due date; (7) Hoegh LNG would reveal that it “will have very limited capacity to extend additional advances to the Partnership beyond what is currently under the Facility”; (8) As a result of the foregoing, the partnership would essentially end distributions to holders of common shares; (9) the COVID-19 pandemic was neither the only nor the main cause of partnership problems in Indonesia; in 2019, before the pandemic, there was already very little demand for the partnership’s gas in Indonesia; (10) The examination, taxation, or maintenance of PGN FSRU Lampung were not the only or primary cause (s) of partnership problems in Indonesia; and (11) as a result, Defendants’ statements about its business, operations and prospects were materially false and misleading and / or were inadequate at all relevant times.

WHAT THIS MEANS FOR THE PARTNERS: If you have suffered a loss in the partnership, you can apply until December 27, 2021 for the court to appoint you as the lead plaintiff. Your ability to partake in a recovery does not require you to be the lead plaintiff.
