General Motors 5.3L Vortec V8 Class Action Lawsuit In Oregon Allowed To Continue

A class action lawsuit against General Motors in Oregon was allowed in court after GM’s motion to dismiss the lawsuit was denied.

The American automaker filed a class action lawsuit against him in the US District Court for the District of Oregon, Portland Division, in February 2020. The plaintiff in the lawsuit, William Martell, claims the 5.3 liter LC9 V8 engine in the 2011 Chevy The Silverado pickup, which he bought new in 2011, has various issues related to excessive oil consumption. The lawsuit is nearly identical to numerous other class action lawsuits filed against GM over the past few years alleging that certain engines in the 5.3-liter Vortec V8 family have multiple issues that lead to them Burn oil at a higher than usual rate.

According to Car Complaints, Judge Michael H. Simon denied GM’s motion to dismiss the Oregon class action lawsuit last week. GM had attempted to deny a warranty breach claim because the lawsuit apparently did not mention engine failures that would be covered by the automaker’s express warranty. The automaker’s express warranty coverage only applies to manufacturing defects, and GM has historically successfully argued that the oil usage error was related to the design of the Vortec V8 engine, rather than a manufacturing defect or faulty component. The judge dismissed GM’s claim this time after examining the wording in its implied warranty for “approximately 10 pages,” reports Car Complaints.

The judge also denied other motions to dismiss the lawsuit filed by GM relating to a fraudulent cover-up allegation and a claim under the Oregon Unlawful Trade Practices Act.

GM has filed multiple class action lawsuits over alleged oil usage issues with the Vortec V8 engine. The majority of these lawsuits have been dismissed by judges, including a statewide class action lawsuit filed in Ohio in 2019.
