“Now we know the truth: it happened everywhere.” This quote comes from the first paragraph of the 2018 report, which first brought to light a significant number of names of sex offenders in the Catholic Church. The report of the dioceses responsible for these predators prompted others to do the same. Two years later, the dioceses of California and New York alone published the names of more than 1,200 clergy who are considered “credibly accused”. As the ranks of the Church change their way of dealing with sexual abusers, the California and New York governments have partially removed what is perhaps the greatest barrier to victims seeking justice: the statute of limitations.

Sexual abuse allegations by the Catholic Church
The catalyst
In 2018, a grand jury examining the extent of sexual abuse of minors in the Catholic Church by a court in Pennsylvania found in its nearly 900-page report that more than 1,000 victims could be identified from Church records alone. Although there are believed to be more victims and perpetrators, the report only confirmed the names of 300 perpetrators. Even so, two months after the report was published, only two priests were charged.

Lawsuit of the Catholic Church
Some of these cases date back to the 1940s, which unfortunately means that until recently, victims were unable to file lawsuits because of statute of limitations on cases of sexual abuse of minors. Statute of limitations can set either the maximum age a victim can have to file a complaint or a maximum length of time after the attack. Still, recent developments suggest that history will not repeat itself.

To learn from mistakes

This report sparked a wave of other dioceses reporting names of clergymen who could be considered “credibly accused”. ProPublica, a New York-based not-for-profit organization focused on investigative journalism, has compiled all of the names reported by dioceses nationwide. This list includes the names of more than 6,700 sex offenders, of whom more than 1,200 are from California and New York alone. Taking the Archdiocese of New York as an example, about three-quarters of the robbers were ordained between 1908 and 1969, which is similar to the situation in Pennsylvania, where the sexual assault is likely so long ago that it can no longer be brought before the court. However, both the California and New York governments have taken steps to make sure it doesn’t in order to avoid what happened before.

The American Catholic Church spent $ 281,611,817 on child sexual abuse incidents in 2019, according to an annual audit of the Catholic Church by the American Bishops’ Conference.

Why you should act now
Last year, both New York and California changed the statute of limitations for underage sexual abuse. California now allows victims to make claims up to the age of 40 or 5 years after the abuse. Previously, the law required that claims must be made before the victim turned 26 or 3 years after the abuse. New York has taken a more drastic measure, allowing victims 55 and older to file a complaint, while it was originally limited to victims under 23. The real hope for victims, however, is the new limited time limit where anyone can file a complaint about their childhood sexual abuse, no matter how long ago it happened. California gives victims three years to file their claim by January 2023, while New York gives only two years and extends its original deadline by one year to August 2021.

A new report from Roman Catholic bishops in the United States lists 4,434 sexual abuse allegations against church clergy in the fiscal year ended June last year – three times the number last year (courtesy The Associated Press).
