According to the complaint, the company has provided false and misleading information to the market throughout the class action period. The complaint alleges that Activision discriminated against both women and minorities who were employed by its organization. Numerous employee complaints about sexual harassment, retaliation, and other inappropriate activities have been reported to HR and senior management, but have not been addressed. The company also failed to inform investors that the California Department of Fair Employment and Housing (“DFEH”) was being investigated on allegations of sexual harassment and other discrimination. Finally in July 2021, Bloomberg law announced that DFEH had filed a lawsuit against Activision after a lengthy two year investigation into the company’s practices. As a result of these facts, Activision’s public statements during the class action period were false and materially misleading.
As a result of this news, the price of Activision shares fell $ 5.89 per share to close at $ 84.95 per share July 27, 2021thereby harming investors.
