Confluence Health Asking For Dismissal of Lawsuit Against It – NewsRadio 560 KPQ

Confluence Health is asking the Douglas County Superior Court to throw out a lawsuit from former employees claiming they were wrongly fired.

The ex-employees argue they were improperly let go after they declined to get vaccinated for COVID-19.

A motion from Confluence Health says the lawsuit fails to establish any grounds that the terminations broke any law.

It says the former employees claims of discrimination against them are inconsistent and contradictory, and should be dismissed.

The motion also relies on a Washington legal rule which calls for a lawsuit to be dismissed if there is no remedy for a complaint.

It would call for a complaint to be thrown out is there’s no legal solution to a claim.

Confluence Health is being sued by 84 former employees who claim they were wrongfully let go from the health system.

The lawsuit claims its the public policy of Washington State that people have the right to make their own healthcare choices and Confluence Health ran counter to that policy by firing its unvaccinated employees.

The complaint claims Confluence lacked any overriding justification to act outside of that policy.

The 84 plaintiffs are asking that the complaint be certified as a class action lawsuit. If not, they are all requesting individual jury trials. Joy Dawe, a former Eastmont School Board member who recently resigned, is among those suing Confluence.

The plaintiffs are seeking reinstatement of their jobs, past and future damages and attorney fees.

The defense motion was filed Thursday by attorneys for Confluence Health, Central Washington Health Services Association and Wenatchee Valley Hospitals and Clinics.
