Communication Failures in Healthcare for Deaf and/or Blind Individuals Lawsuit Investigation

Who’s Affected: Deaf and/or Blind Individuals Experiencing Communication Difficulties in Obtaining Healthcare Services

Are you a person with a disability who has had trouble accessing health care services (such as at a doctor’s office, testing lab, or rehab center) due to a lack of effective communication by your healthcare provider? If so, you may have a legal claim.

Many medical providers (including doctors, dentists, and physical therapists) often ask blind patients to use inaccessible touchscreen kiosks to check in to receive their healthcare. For example, Quest Diagnostics, a company that provides medical lab services nationwide, recently faced legal action concerning the accessibility of its healthcare kiosks.

Other healthcare providers may fail to provide deaf patients with interpreters during their doctor’s appointments and hospital stays. Still other providers fail to provide forms to blind patients in accessible formats. All of these communication impediments may violate federal and state law.

the Americans with Disabilities Act (ADA) prohibits places of public accommodation, including medical offices and hospitals, from failing to communicate effectively with deaf and/or blind individuals.

If you are blind or deaf and were unable to meaningfully participate in your own medical care due to the healthcare facility’s ineffective communication, you may be eligible to join a free legal investigation.

For example, Quest Diagnostics has already faced a legal challenge related to its failure to provide kiosks that are accessible to people with disabilities. A certified ADA class action lawsuit filed in 2019 asserts that a blind patient had no way to utilize the touchscreen kiosks at Quest facilities, which provide sighted Quest patients with a number of important services, including check-in. Many other healthcare providers also fail to provide their blind and deaf patients with accessible check-in kiosks.

Communication difficulties are common in many healthcare contexts, including but not limited to:

  • Doctor’s offices
  • Dentist’s offices
  • Diagnostic laboratories and imaging centers
  • hospitals
  • Rehabilitation facilities
  • Retail dental clinics
  • Retail optometry clinics
  • Tele-health visits

Effective Communication in Healthcare Legal Requirements

Many medical providers routinely fail to provide effective communication to their deaf and blind patients. This can take the form of an inaccessible kiosk, a lack of ASL interpreters, or the failure to provide medical forms in an accessible format. All of these communication failures may constitute a violation of federal law.
