Class action lawsuit claims Nespresso warranty unlawful, seeks damages

A customer has sued Nespresso USA Inc. for requiring customers to use items and service from a particular company to keep their machine warranty coverage, according to a filing in the US District Court Southern District of New York.

The suit demands compensatory, statutory and punitive damages to be determined by the court and/or jury.

Abigail Shaughnessy of Winthrop, Massachusetts filed the class action lawsuit against Nespresso claiming its warranty conditions for a Nespresso Vertuo machine violated federal law and is demanding a trial by jury.

Consumers, according to the complaint, must purchase Nespresso Vertuo branded coffee capsules from Nespresso at inflated prices to maintain their warranty coverage.

Shaughnessy claims that she had known the “tying arrangement” was unlawful, she would not have bought the product or paid “significantly less for it.”

The suit claims the company gave “false or misleading material information” about the products.

The company did not respond to a Vending Times request for comment at the time of this report.
