Legal Members – Solicitors

The Solicitor Member must be a solicitor or solicitor advocate practicing as such in Scotland.

The role of the Legal Member is to participate in decision-making on the suitability of individual applicants for judicial or tribunal appointment and contribute to the development of the board’s policies. You will receive training in the Boards processes and its approach to appointment exercises.

For appointment exercises in which they are involved the Legal Member will:

Contribute to the creation and execution of the appointment exercise. This will include:

  • Assessing application forms for applicants for judicial office against the board’s criteria for appointment (this is done independently, usually at home).
  • Contributing to the assessment of applicants’ knowledge of the law, or skills and competence in the interpretation and application of the law.
  • Attending meetings to select shortlisted applicants for interview and, later, to agree who to recommend for appointment.
  • Participating in interview panels.
  • Comment on draft Panel reports which are submitted to the Board

Remuneration: The current fee is £296 per day. Expenses incurred as a result of carrying out the duties of the appointment, including reasonable travel and subsistence costs and dependent carer and childcare expenses, will be reimbursed.

Time commitment: Members will be expected to devote up to 30-40 days per year but this may vary year on year and within any year. The number and nature of recruitment exercises varies but, typically an appointment round involves sifting applications at home within a four week period, a couple of days on planning and preparation and a week or so of interviewing. There are short periods of intense work but not everybody on the board is heavily involved in each appointment round. However, all board members are expected to attend board meetings and an annual workshop. Board members also participate in working groups and contribute to improvement projects. In addition, board members may be invited to attend engagements with key stakeholders.

Period of Appointment: The term of appointment will be for up to 4 years. There is the possibility of reappointment subject to evidence of effective performance and having regard to the skills, knowledge, understanding and experience required by the Board at the time. Any appointments and subsequent reappointments will not extend beyond a maximum of eight years.
